MIETVERTRAG UND HAFTUNGSAUSSCHLUSS DIESER MIETVERTRAG UND HAFTUNGSAUSSCHLUSS (Dies "Zustimmung “) wird von und zwischen der Person abgeschlossen, die die Reservierung einreicht (im Folgenden „Klient “) und Mango Beach Baby Rentals, SRL („Mango “) ab dem Datum, an dem der Kunde seine Bestellung aufgibt („Reservierung “) (dieses Datum, das „Datum des Inkrafttretens “) und gilt für alle Mietgeräte, die der Kunde als Teil seiner Reservierung ausgewählt hat (das „Ausrüstung “). Mango bleibt alleiniger Eigentümer der gesamten Ausrüstung. Mango bietet die Ausrüstung nicht zum Verkauf an und der Kunde kauft sie nicht. Der Kunde erkennt hiermit an, dass die Ausrüstung nur für den persönlichen Gebrauch bestimmt ist. Durch das Absenden seiner Reservierung bestätigt der Kunde, dass er die nachstehenden Bedingungen gelesen und verstanden hat und ihnen zustimmt: RESERVIERUNG UND ZAHLUNG DER AUSRÜSTUNG Die Reservierung des Kunden wird hierin durch Bezugnahme aufgenommen. Die Zahlung ist zum Zeitpunkt der Reservierung fällig, wobei eine der von Mango von Zeit zu Zeit angebotenen Zahlungsmethoden verwendet wird. Der Kunde stimmt zu, Mango zu gestatten, Änderungen, Anpassungen und Ergänzungen an der/den Zahlungsform(en) vorzunehmen, um Dienstleistungen oder Gebühren im Zusammenhang mit der Reservierung des Kunden gutzuschreiben, zu erstatten und zu berechnen. Mango bestätigt die Reservierung des Kunden per E-Mail innerhalb eines (1) Werktages. Der Kunde sollte Mango kontaktieren, wenn innerhalb eines (1) Werktages nach Übermittlung seiner Reservierung keine Bestätigungs-E-Mail eingeht. Die Farben/Modelle der Produkte können von den online gezeigten Bildern abweichen. LIEFERUNG, BESITZ UND VERWENDUNG DER AUSRÜSTUNG Zum Zeitpunkt der Reservierung gibt der Kunde den Namen und Ort des Resorts, Hotels oder Ferienhauses an, wo die Ausrüstung geliefert und abgeholt wird. Der Kunde erkennt an und versteht, dass die Lieferverfahren je nach gewähltem Standort variieren können. Der genaue Zeitpunkt und Ort der Lieferung wird dem Kunden per E-Mail mitgeteilt. Wenn der Kunde sich bezüglich des Lieferorts nicht sicher ist, verpflichtet er sich, Mango zur Klärung zu kontaktieren. Der Kunde versteht, dass die Preise für die Ausrüstung auf Adressen in der unmittelbaren Umgebung von Playas del Coco/Playa Hermosa basieren. Derzeit werden Adressen außerhalb dieses Bereichs nicht von Mango bedient; Mango liefert und holt jedoch gegen eine zusätzliche Gebühr von 25 USD pro Fahrt am Flughafen Liberia ab; 50€ für Lieferung und Abholung. Der Kunde verpflichtet sich, Mango mindestens sechs (6) Stunden vor der vereinbarten Lieferzeit telefonisch oder per E-Mail zu kontaktieren, wenn der Kunde nicht in der Lage ist, den/die Mietgegenstand(e) am vereinbarten Ort entgegenzunehmen und /oder Zeit. Der Kunde erklärt sich damit einverstanden, dass dem Kunden eine Versandgebühr von 25 $ in Rechnung gestellt werden kann, wenn er sich verspätet, seine Lieferzeit versäumt oder anderweitig nicht verfügbar ist, um sich mit einem Vertreter von Mango zum vereinbarten Zeitpunkt zu treffen. Der Kunde erkennt ferner an und stimmt zu, dass Lieferungen und/oder Abholungen in Zeiten extremen Wetters zur Sicherheit des Lieferpersonals vorübergehend ausgesetzt werden können, bis es vom Management als sicher erachtet wird, den Betrieb fortzusetzen (extremes Wetter kann beinhalten, ist es aber nicht beschränkt auf: starker Regen, tropische Stürme/Hurrikane, Tornadowarnungen, Windgeschwindigkeiten über 40 km/h). Der Kunde erkennt an und stimmt zu, dass jeder Mangel an der Ausrüstung Mango innerhalb von sechs (6) Stunden nach der Lieferung gemeldet werden muss, andernfalls akzeptiert der Kunde den Besitz der Ausrüstung „WIE BESEHEN“ und ist für die mit etwaigen Mängeln verbundenen Kosten bei Rückgabe an Mango verantwortlich . Der Kunde erklärt und garantiert, dass er alle Anstrengungen unternommen hat, um sicherzustellen, dass seine gewünschten Liefer- und Rückgabeorte innerhalb des angegebenen Liefergebiets liegen, das von Mango bedient wird. Der Kunde stimmt zu, dass seine Reservierung jederzeit nach Ermessen von Mango geändert oder storniert werden kann, wenn Mangos Liefergebiet. GERÄTERÜCKGABE Der Kunde verpflichtet sich, Mango mindestens zwei (2) Stunden vor der vereinbarten Rückholzeit telefonisch zu kontaktieren, wenn der Kunde nicht in der Lage ist, sich mit einem Vertreter von Mango zu treffen. Der Kunde erkennt an und stimmt zu, dass dem Kunden eine Versandgebühr von 25 $ in Rechnung gestellt werden kann, wenn er sich verspätet, seine geplante Rückgabezeit verpasst oder anderweitig nicht verfügbar ist, um sich mit einem Vertreter von Mango zum vereinbarten Zeitpunkt zu treffen. Der Kunde erklärt sich damit einverstanden, eine verfügbare Zeit für die Abholung der Rücksendung auszuwählen, in der der Kunde verfügbar ist, um sich persönlich mit einem Vertreter von Mango zu treffen. Es liegt in der Verantwortung des Kunden, zur vereinbarten Zeit und am vereinbarten Ort für die Abholung der Rücksendung verfügbar zu sein. Wenn der Kunde außerhalb des Liefer-/Abholbereichs von Mango gereist ist und nicht zurückkehren kann, liegt es in der Verantwortung des Kunden, sicherzustellen, dass alle Geräte am ursprünglichen Rückgabedatum und -uhrzeit mittels Taxi, Mitfahrdienst oder Kurier an Mango zurückgegeben werden. Alle Kosten für eine solche Rücksendung liegen in der alleinigen Verantwortung des Kunden. Wenn der Kunde die Mietdauer verlängern möchte, muss der Kunde Mango mindestens vierundzwanzig (24) Stunden vor der vereinbarten Rückgabezeit kontaktieren, um die Verfügbarkeit zu bestimmen. Mango kann nach eigenem Ermessen eine beantragte Verlängerung gewähren oder ablehnen. Mango behält sich das Recht vor, die Karte des Kunden zu belasten, und der Kunde genehmigt hiermit eine solche Belastung mit dem täglichen Mietbetrag für jeden item der Ausrüstung für jeden zusätzlichen Tag oder Bruchteil eines Tages, den die Ausrüstung vom Kunden aufbewahrt wird, unabhängig davon, ob es sich um einen solchen handelt Erweiterung wurde von Mango genehmigt oder nicht. BESCHÄDIGUNG UND VERLUST DER AUSRÜSTUNG Der Kunde übernimmt die volle Verantwortung für die Pflege der Ausrüstung während der Mietzeit. Für den Fall, dass die Ausrüstung unbeschädigt wiedererlangt wird, nachdem der Kunde gemäß dem vorstehenden Satz belastet wurde, wird dem Kunden die Ersatzgebühr vollständig erstattet, abzüglich aller damit verbundenen Transaktionsgebühren, einer Wiederherstellungsgebühr von 125 USD und der täglichen Gebühr für die Verlängerung Vermietung. Der Kunde erkennt an und stimmt zu, dass eine solche Belastung gültig ist, und er darf diese Belastung nicht bei seinem Kreditkartenunternehmen oder seiner Bank anfechten. Der Kunde verpflichtet sich, die Ausrüstung in demselben Zustand wie bei der Lieferung zurückzugeben und Mango jeden Verlust, Diebstahl, jede Beschädigung oder Zerstörung der Ausrüstung unverzüglich zu melden. Der Kunde ermächtigt Mango hiermit, das hinterlegte Zahlungsmittel des Kunden für die Reparatur oder, falls eine Reparatur nicht durchführbar ist, für den Ersatz der an Mango mit Mängeln oder Beschädigungen zurückgesendeten Geräte zu belasten. Der Kunde erkennt an und stimmt zu, dass eine solche Belastung gültig ist, und er darf diese Belastung nicht bei seinem Kreditkartenunternehmen oder seiner Bank anfechten. HAFTUNGSVERZICHT Durch die Annahme und Verwendung der Ausrüstung erkennt der Kunde im eigenen Namen und im Namen jedes Benutzers der Ausrüstung an und stimmt zu, dass eine solche Verwendung auf eigenes Risiko erfolgt. Mango gibt hiermit keine Zusicherungen oder Gewährleistungen in Bezug auf die Ausrüstung ab, und Mango lehnt hiermit ausdrücklich alle ausdrücklichen oder stillschweigenden Gewährleistungen ab. Der Kunde erkennt an und stimmt zu, dass Mango nicht der Hersteller solcher Geräte ist, und der Kunde sollte das Benutzerhandbuch für jedes Gerät auf der Website des Herstellers lesen, um sicherzustellen, dass der Kunde es ordnungsgemäß verwendet. Mango und seine Mitarbeiter, Eigentümer und verbundenen Unternehmen sind nicht verantwortlich für Unfälle, Verletzungen oder Schäden, die direkt oder indirekt durch die Verwendung oder den Missbrauch der Ausrüstung verursacht werden. Der Kunde erklärt sich im eigenen Namen und im Namen jedes Benutzers damit einverstanden, Mango und seine Mitarbeiter, Eigentümer und verbundenen Unternehmen von jeglicher Haftung, Verletzung, Tod, Eigentumsverlust oder -schaden freizustellen, zu verteidigen und schadlos zu halten, die direkt oder indirekt aus der Verwendung der Ausrüstung resultieren können . Diese Vereinbarung unterliegt den Gesetzen von Costa Rica. OPTIONALE VERSICHERUNGSBEDINGUNGEN Eine Versicherung, die Diebstahl, Zerstörung oder versehentliche Beschädigung abdeckt, kann vor Abschluss der Reservierung und bis zu vierundzwanzig (24) Stunden vor der Inbesitznahme der Ausrüstung abgeschlossen werden. Der Kunde erkennt hiermit an, dass ihm die Möglichkeit angeboten wurde, eine Versicherung abzuschließen, um den Diebstahl, die Beschädigung oder die Zerstörung der Mietsache(n) abzudecken. Sobald sich die Ausrüstung im Besitz des Kunden befindet, kann keine Versicherung erworben werden. Es liegt in der alleinigen Verantwortung des Kunden zu entscheiden, ob er die Zusatzversicherung abschließen oder auf sein Recht verzichten möchte. Soweit der Kunde sich für den optionalen Versicherungsschutz entscheidet, gilt diese Versicherung nur für die Ausrüstung in der entsprechenden Reservierung, für die eine Versicherung abgeschlossen wurde. Der Versicherungsschutz ist nicht übertragbar und nur während der Mietzeit wirksam und durchsetzbar. Der Kunde verliert jeglichen Anspruch auf den Versicherungsschutz, wenn der Kunde die Kontrolle oder den Besitz der Ausrüstung zu irgendeinem Zeitpunkt an eine Person abtritt, die nicht Teil der ursprünglichen Vereinbarung ist. Der Kunde erkennt an und stimmt zu, dass zu keinem Zeitpunkt Erklärungen von Mango-Mitarbeitern oder vom Kunden verstanden werden, dass die Verantwortung des Kunden für die Ausrüstung ohne den Abschluss einer Versicherung aufgelöst wurde.
