RENTAL AGREEMENT AND LIABILITY WAIVER

THIS RENTAL AGREEMENT AND LIABILITY WAIVER (this “Agreement”) is entered into by and between the individual submitting the Reservation (hereinafter “Client”) and Mango Beach Baby Rentals, SRL (“Mango”) as of the date Client submits its order (“Reservation”)(such date, the “Effective Date”) and applies to all rental equipment selected by Client as part of its Reservation (the “Equipment”). Mango remains the sole owner of all of Equipment. Mango is not offering for sale, and Client is not purchasing, the Equipment.
Client hereby acknowledges that the Equipment shall be for personal use only. By submitting its Reservation, Client acknowledges that it has read, understood and agrees to the terms stated below:
EQUIPMENT RESERVATIONS & PAYMENT
Client's Reservation is incorporated herein by reference.
Payment is due at the time of making the Reservation utilizing one of the payment methods offered from time to time by Mango. Client agrees to allow Mango to make alterations, adjustments, and additions to the form(s) of payment for the purposes of crediting, refunding, and charging for any service or fee associated with Client’s Reservation.
Mango will confirm Client’s Reservation by email within one (1) business day. Client should contact Mango if a confirmation email is not received within one (1) business day of submission of its Reservation.
The colors/models of products may vary from the images shown online.
EQUIPMENT DELIVERY, POSSESSION & USE
At the time of Reservation, Client will specify the name and location of the resort, hotel or vacation home where the Equipment will be delivered and retrieved. Client acknowledges and understands that delivery procedures may vary based on the chosen location. The exact time and location of delivery will be communicated via email to Client. If Client is unsure as to the location of the delivery, Client agrees to contact Mango to clarify. Client understands that Equipment pricing is based on addresses in the immediate Playas del Coco/Playa Hermosa area. At this time, addresses outside of this area are not serviced by Mango; however, Mango will deliver and pickup at Liberia Airport for an additional fee of $25 per trip; $50 for both delivery and pickup.
Client agrees to contact Mango at least six (6) hours prior to the agreed delivery time by phone or email if Client is unable to take delivery of the rental item(s) at the agreed upon location and/or time. Client agrees that if Client is late, misses its delivery time or is otherwise unavailable to meet with a representative of Mango at the agreed upon time, Client may be charged a $25 dispatch fee. Except for White Glove Service clients, Client agrees to select an available time for delivery in which Client will be available to meet with a representative of Mango face to face. Client also agrees and understands that only the times listed on the website at www.MangoBabyBeach.com are available, subject to confirmation by Mango, and that other times are not available unless specific exceptions and arrangements are made through Mango via email.
Client acknowledges and agrees to the following cancellation schedule for all Equipment:

Client acknowledges and agrees that all deliveries are made with earnest effort to meet the requested delivery time but, due to circumstances outside Mango’s control, there is an allowable thirty (30) minute window of the requested delivery time. The Client further acknowledges and agrees that during times of extreme weather, deliveries and/or pick ups may be temporarily suspended for the safety of delivery personnel until such time as it is deemed safe by management to continue operations (extreme weather may include, but is not limited to: heavy rain, tropical storms/hurricanes, tornado warnings, winds exceeding 25mph).
Client acknowledges and agrees that any defect in the Equipment must be reported to Mango within six (6) hours of the delivery, otherwise Client accepts possession of the Equipment “AS IS” and is responsible for the costs associated with any defects upon return to Mango.
Client represents and warrants that it has made every effort to verify that its desired delivery and return locations are within the stated delivery area serviced by Mango. Client agrees that its Reservation may be altered or canceled at any time at Mango's discretion if outside the stated delivery area.
Client acknowledges and agrees that its Reservation may be altered or canceled at Mango's discretion if Mango deems the desired hotel, resort or vacation home poses a health or safety concern. Client agrees to maintain possession of the Equipment throughout the course of the rental period. Equipment is to be kept in a safe and secure location when not in use.
Client acknowledges and agrees that any Equipment exchange due to Client’s use which shall include, without limitation: stroller left in rain, child vomit, leaking diaper or other bodily fluid, will incur a $25 exchange and cleaning fee.
Except for White Glove Service clients, Client agrees to contact Mango at least two (2) hours prior to the agreed upon return pickup time by telephone if Client is unable to meet with a representative from Mango. Client acknowledges and agrees that if Client is late, misses its scheduled return time or is otherwise unavailable to meet with a representative of Mango at the agreed upon time, Client may be charged a $25 dispatch fee. Client agrees to select an available time for return pick up in which Client will be available to meet with a representative of Mango face to face. It is the responsibility of Client to be available at the agreed upon time and location for the return pick up.
Client understands that any Equipment returned or abandoned at a location outside of Mango’s stated delivery area may incur a $125 recovery fee. If Client has traveled outside of Mango’s delivery/pick up area and is unable to return, it is Client's responsibility to ensure that all Equipment is returned to Mango on the original return date and time by means of taxi, ride share services, or courier. All charges for any such return shall be the sole responsibility of Client.
If Client is wishes to extend the rental period, Client must contact Mango at least twenty-four (24) hours before the agreed upon return time to determine availability. Mango may, at its sole discretion, grant or deny a requested extension. Mango reserves the right to charge Client's card and Client hereby approves such charge for the daily rental amount for each item of Equipment for each additional day or fraction of a day the Equipment is kept by Client, whether such extension was approved or not by Mango.
EQUIPMENT DAMAGE & LOSS
Client accepts full responsibility for the care of the Equipment during the rental period. In addition to daily rental fees, Client acknowledges and agrees that it is responsible for, and hereby authorizes Mango to charge its payment method on file, for the full replacement value of all Equipment rented under this Agreement that is not returned to Mango within twenty-four (24) hours of the end of the rental period. In the event Equipment is recovered undamaged after Client has been charged in accordance with the foregoing sentence, a full refund of the replacement charge will be issued to the Client, less any associated transaction fees, a $125 recovery fee and the daily charge for the extended rental. Client acknowledges and agrees that such charge shall be valid and it shall not dispute such charge with its credit card company or bank.
Client agrees to return the Equipment in the same condition as it was delivered, and to report any loss, theft, damage or destruction of the Equipment immediately to Mango. Client hereby authorizes Mango to charge Client’s payment method on file for the repair or, if repair is not feasible, replacement cost of Equipment returned to Mango with defects or damage, after deduction of the security deposit amount held by Mango. Client acknowledges and agrees that such charge shall be valid and it shall not dispute such charge with its credit card company or bank. Client further acknowledges and agrees that, to the extent its approval is required for payment of such additional amount, it shall promptly provide any and all such approvals required for the completion of such transaction.
WAIVER OF LIABILITY
By accepting and using the Equipment, Client on behalf of itself and each user of the Equipment, acknowledges and agrees that such use is at its own risk. Mango hereby makes no representations or warranties with respect to the Equipment, and Mango hereby specifically disclaims all warranties, whether express or implied. Client acknowledges and agrees that Mango is not the manufacturer of any such Equipment and Client should review the owner’s manual for each piece of Equipment on the manufacturer’s website to ensure Client utilizes it appropriately.
Mango and its employees, owners and affiliates are not responsible for accidents, injuries or damages caused directly or indirectly by the use or misuse of the Equipment. Client on behalf of itself and each user, agrees to indemnify, defend and hold harmless Mango and its employees, owners and affiliates, from any liability, injury, death, property loss or damage which may result directly or indirectly from the use of the Equipment.
This Agreement is governed by the laws of Costa Rica.
SECURITY DEPOSIT TERMS & CONDITIONS
Client shall, at the time of checkout, be required to make payment of a security deposit representing 25% of the value of its Reservation with Mango. Such Security Deposit amount shall be refunded by Mango to Client upon expiration of the rental period, subject to Client's return of the Equipment in perfect working condition and also subject to Mango setting off the refundable security deposit amount, or part thereof, with any amount receivable by Mango from Client on such date of expiration (e.g. recovery fees or additional rental days).
Notwithstanding the payment and application of a security deposit, Client acknowledges and agrees that the security deposit shall not act as a limitation on its liability or responsibility for the Equipment, and Client shall, at all times, remain responsible for all costs and expenses associated with any damage, loss, repairs or replacement necessary for the Equipment. Client hereby authorizes Mango to charge Client’s payment method on file for the repair or, if repair is not feasible, replacement cost of Equipment returned to Mango with defects or damage, after deduction of the security deposit amount held by Mango. Client acknowledges and agrees that such charge shall be valid and it shall not dispute such charge with its credit card company or bank. Client further acknowledges and agrees that, to the extent its approval is required for payment of such additional amount, it shall promptly provide any and all such approvals required for the completion of such transaction.
